What is eDiscovery?

Electronic documents (e-documents) are becoming the dominant form of evidence requested for litigation purposes. Producing e-evidence is not easy. Approximately 90 percent of new business records are created electronically, and 40 percent of them are never converted to paper.

Electronic evidence is the predominant form of discovery today. There is growing evidence that organizations are unprepared for this in the digital age. Organizations respond, but often in a disorganized and hasty fashion, which adds cost and risk to the operation. 

Electronic Discovery or eDiscovery refers to inquiries (discovery) in civil litigation where electronically stored information is searched, read and flagged for future proceedings.  Electronic Information can come in the form of e-mail, internal documents, text messages, SMS messages, Instant messages or a myriad of other type of electronic communication mediums.  This does not exclude traditional paper documents that can be scanned and digitally converted to electronic documents.

One of the difficulties of eDiscovery compliance is the sheer amount of electronic information that corporate entities have and the amount of electronic information their employees produce every day.   These difficulties manifest in two distinct ways – eDiscovery systems and eDiscovery services that can encompass Litigation Support, eDiscovery Vendors or a human based process.
